I. Completion of the contract
By completing and sending the electronic order form you are submitting a declaration of intent for the conclusion of a sales contract and are therewith accepting our general terms and conditions. The Tao Chan Zen Center e.V. will make all efforts to process your order as quickly as possible. In the case where the ordered article is sold out we reserve the right of non-delivery. Prices and conditions are as according to the current version. Concluded contracts are not affected by any alterations. The right to alter prices arising from print errors is reserved. Your data is saved and retained by us and will not be passed on to third parties. When we have received your order we shall send you a confirmation by e-mail.
II. Prices and methods of payment
The prices shown are inclusive of value added tax (VAT). When posting to a non- EU state the VAT will be deducted by us from the price. With the dispatchment of your order we will include mailing charges which depend on the format and weight of you order.
We will only charge you the mailing charges which are effectively incurred.
The costs of mailing to another country or packet costs are available on request. With re-occuring delivery, due to absence or refusal of delivery we will invoice the mailing costs anew. The goods remain our property until they have been paid in full.
We request payment within 10 days of receiving the invoice, which you will receive with the delivery. For foreign orders we request payment in advance. You will receive an invoice either by e-mail or by letter. Following receipt of payment you will promptly receive the goods.
III. Conditions of Guarantee
In case of reclamation please contact the Tao Chan Zen Center as quickly as possible. The contact person is Mr. Klaus Pauly, Adelheidstr. 37, 65185, Wiesbaden. You may also contact us through our e-mail address. When we have received the returned goods, for which a flaw on our part has been ascertained we shall send you a flaw-free replacement. Where the legal requirements for the guarantee are fulfilled the following alternative rights exist: if the rectification of the defects should miscarry you have the right to cancel the contract, to reduce the purchase price, to claim for compensation or to demand a reimbursement for the unavailing expenditure. Please check the delivery of goods upon reception for transit damage. Where goods have been damaged during transportation, be it externally or internally, please obtain a confirmation of the damage from the deliverer and send it to us. The place of fulfillment for delivery and payment is Wiesbaden. As far as agreements on jurisdiction are permitted, Wiesbaden is the chosen place of jurisdiction. German law applies for all contractual relationships with a foreign connection.
IV Right of withdrawal
The order can be withdrawn without need of justification within a time period of two weeks, following delivery of the goods. The withdrawal can be made in the written form or by returning the goods to Tao Chan Zentrum e.V., Marcobrunnerstraße 18, 65197 Wiesbaden. The dispatch date suffices for assessment of the above time period. By exercising the right of withdrawal it is required that the goods be returned. The costs of returning the goods is to be borne by the buyer when the delivered goods are those which were ordered and when the price of those goods being returned does not exceeed 40 euros, or for a higher price of the goods when the buyer at the time of the withdrawal has not yet paid or a partial payment has not yet been contractually agreed upon. In all other cases there is no charge for the cost of returning the goods.
Obligations for the reimbursement of payment must be fulfilled by the buyer within 30 days following postage of the buyer’s written revocation. Payments already received will be reimbursed. The right of withdrawal lapses for deliveries of audio or video recordings where the delivered data medium has had the seal removed by the buyer. The right of compensation is reserved where deterioration of the goods is seen to be the buyer’s responsibility. This is not the case where the deterioration of the goods has been solely caused by their examination. |
V. Liability
The Tao Chan Zen center does not accept any liability for damage to assets and property which is not caused through a deliberate or wantonly negligent breach of duty of the center or servants thereof. We point out that we can neither guarantee an uninterrupted internet presence nor an error-free transfer and availability of the electronic data.
